ANALISIS PEMILIHAN MODEL KONTRAK FIDIC RAINBOW CONTRACT 2017 PEKERJAAN PEMBANGUNAN DERMAGA (KAJIAN DARI SUDUT PANDANG PENGGUNA JASA)

Abstract

Abstrak: Dalam penyelenggaraan jasa konstruksi, kontrak antara Pengguna Jasa dan kontraktor merupakan bagian paling penting untuk kedua belah pihak agar menjadi perhatian khusus. Konstruksi dermaga mempunyai spesifikasi khusus, dibanding spesifikasi pada Konstruksi umumnya. Beberapa bagian dari konstruksi  Dermaga adalah pekerjaan di bawah air, yang berarti akan ada banyak kondisi yang tak terduga yang dapat menyebabkan perubahan desain yang berhubungan dengan setiap tahapan pekerjaan. Untuk itu perlu adanya analisis pemilihan model kontrak konstruksi pekerjaan pembangunan dermaga agar terjadi keseimbangan antara hak dan kewajiban. Analisis yang dilakukan adalah perbandingan antara FIDIC  Conditions of Contract (Red Book) yang dikenal sebagai kontrak unit price dan FIDIC EPC / Turnkey (Silver Book) sebagai kontrak lumpsum. Keduanya diterbitkan oleh FIDIC sebagai badan internasional yang didirikan pada tahun 1913. Berdasarkan analisis yang dilakukan dengan menggunakan RII (Relative Importance Index) berdasarkan sudut pandang dari pengguna jasa diperoleh 11 kriteria Kontrak Konstruksi, yang pertama kali digunakan oleh Khaled Bu-Bshait 1990, sedangkan hasil analisis dengan metode uji signifikasi diperoleh bobot prosentase untuk red book sebesar 48,9 % lebih baik dari silver book 35,1%. Dapat disimpulkan bahwa berdasarkan sudut pandang dari pengguna jasa red book adalah pilihan terbaik untuk pekerjaan konstruksi Dermaga dibandingkan dengan model kontrak yang lain.

Abstract: As the basic of the construction services, the ‘Contract’ between the Employer and the Contractor is the most important part that both parties have to pay special attention and care. The construction of the ‘Dermaga’ here to be done by the special specifications, instead of the common specifications. Some parts of the constructions are underwater works, which means there will be many unforeseen condition which may led to  changing in design which are related with every stages of the works. Therefore it is necessary to analyze the selection of construction contract model of ‘Dermaga’ construction work in order to have the fair and balance condition. The analysis will involve the comparisons between FIDIC Conditions of Contract (red book) which is known as the unit price contract and FIDIC Condition of Contract EPC/Turnkey (silver book), as the lump sump contract both are the model contract  published by FIDIC as the international body established in 1913. Analysis have been done, based on the point of view of the Employer using the RII to the 11 criteria that firstly used by Khaled Bu-Bshait 1990, and then by the significance test it have been founded that red book have 48,9% which the silver book 35,1%. Based on the point of view of the Employer  it could be concluded that the red book is the best choice for the (Dermaga) construction project compared with other model contract.
