ANALISIS RED FLAG CLAUSES PADA FIDIC RAINBOW 2017

Abstract


Abstrak : Penggunaan FIDIC Conditions of Contract 1999 di Indonesia, dalam praktiknya, ternyata banyak terjadi klaim yang diajukan berdasarkan klausula-klausula tertentu di dalam FIDIC Conditions of Contract 1999 yang berujung terjadinya sengketa konstruksi. Klausula-klausula tersebut adalah klausula yang terkait dengan perubahan baik volume maupun waktu dengan akibat adanya tambahan harga kontrak yang dikenal sebagai red flag clauses. Penelitian ini dilakukan dengan tujuan untuk mengetahui red flag clauses yang banyak digunakan kontraktor sebagai dasar pengajuan klaim pada FIDIC Rainbow Series 1999 serta menyandingkan red flag clauses tersebut dengan FIDIC Rainbow Series 2017. Penelitian ini adalah penelitian mixed method, diawali dengan literature review. Uji pakar dilakukan dengan menggunakan Teknik Delphi. Kuesioner disusun berdasarkan studi literatur terhadap studi terdahulu dan FIDIC Rainbow Series 1999.  Kuesioner menggunakan skala Likert berskala 6. Analisis faktor dilakukan dengan menggunakan SPSS 23.0 untuk menemukan red flag clause dominan. Analisis kualitatif dilakukan dengan display data dan triangulasi data untuk membandingkan temuan dengan FIDIC Rainbow Series 2017. Berdasarkan hasil analisis kuantitatif ditemukan bahwa red flag clause dominan pada FIDIC Rainbow Series 1999 adalah Sub-Clause 2.1 (Right of Access to the Site). Berdasarkan hasil analisis kualitatif dapat disimpulkan bahwa klausula tersebut lebih dapat dijelaskan pada FIDIC Rainbow Series 2017 sehingga meminimalisir terjadinya misinterpretasi terhadap red flag clauses.

Abstract : The use of the FIDIC Conditions of Contract 1999 in Indonesia, in practice, it turns out that many claims have been made based on certain clauses in the FIDIC Conditions of Contract 1999 which led to construction disputes. These clauses are clauses related to changes in both volume and time due to additional contract prices known as red flag clauses. This research was conducted to find out which red flag clauses are widely used by contractors as the basis for filing claims on FIDIC Rainbow Series 1999 and juxtaposing these red flag clauses with FIDIC Rainbow Series 2017. This research is a mixed method study, started with literature review. Expert test was carried out using the Delphi Technique. The questionnaire was compiled based on a literature study of previous studies and FIDIC Rainbow Series 1999. The questionnaire used a 6-scale Likert scale. Factor analysis was performed using SPSS 23.0 to find the dominant red flag clause. Qualitative analysis was carried out by displaying data and triangulating data to compare findings with FIDIC Rainbow Series 2017. Based on the results of the quantitative analysis it was found that the dominant red flag clause in FIDIC Rainbow Series 1999 was Sub-Clause 2.1 (Right of Access to the Site). Based on the results of qualitative analysis, it can be concluded that the clause can be more explained in the FIDIC Rainbow Series 2017 so as to minimize the occurrence of misinterpretation of the red flag clauses.
